CONTENT AND PLATFORM CONDUCT GUIDELINES
Adherence to Guidelines
This comprehensive policy aims to create a safe, respectful, and legally compliant environment for content Creators, subscribers, and general Users of the Platform. All Users are encouraged to familiarize themselves with these guidelines and to contribute to a positive community experience.
The Platform reserves the right to update these policies as necessary to comply with changing laws and community needs.
Prohibited Content
Illegal Activities: Any content that promotes, depicts, or facilitates activities prohibited by Indian law. Content related to terrorism, drug trafficking, human trafficking, illegal weapons, or any other criminal activities.
Hate Speech and Discrimination: Any Content that promotes or incites hatred, violence, or discrimination against individuals or groups based on protected characteristics such as race, religion, caste, gender, sexual orientation, or national origin shall not be entertained on Our Platform.
The use of derogatory language, slurs, stereotypes, or content that promotes supremacist ideologies is completely and strictly prohibited.
Explicit Sexual Content: Any Content that depicts graphic sexual acts, nudity, or pornography shall not be entertained on Our Platform. The platform strictly prohibits any content or activities related to prostitution, sex work, or the offering of sexual services.
This includes, but is not limited to, solicitation, promotion of escort services, or any content that could be construed as facilitating or encouraging such activities.
The use of pornographic images, videos, or text; non-consensual intimate imagery; sexually explicit content involving minors via any medium, comment, etc. is strictly prohibited.
Such Content taken from another Platform or involving a minor (paedophilia) or involving an animal or promoting and showcasing cannibalism and/or necrophilia or used for the purposes of defamation, revenge porn or any other unethical and moral violation.
Violence and Gore: Content featuring graphic violence, extreme gore, death or the glorification of violent acts is not permitted. This includes real-life depictions of violence, simulated violence, or any content that could be considered excessively violent or disturbing.
Copyright Infringement: Users and content creators must respect intellectual property rights. Unauthorized use, reproduction, or distribution of copyrighted materials, including but not limited to text, images, videos, music, and software, is strictly prohibited.
Misinformation and Fake News: The dissemination of false or deliberately misleading information, manipulated media or unverified claims including but not limited to fake news, conspiracy theories, or deliberately deceptive content, is prohibited.
Users are required to fact-check their content and provide accurate information to the best of their knowledge.
Other Prohibited Activities
Any sale, promotion, preaching, practice, comment, conversation, course, or product related to the below-mentioned prohibited activities is strictly forbidden on the platform. Users and content creators are responsible for ensuring that their content does not directly or indirectly promote or facilitate any of these prohibited activities.
Alcohol and Tobacco: The sale, promotion, advertisement, or encouragement of alcohol and tobacco products is strictly prohibited on the platform. This includes, but is not limited to, images, videos, text, or any other form of content that depicts or references alcohol or tobacco products in a manner that could be construed as promotional.
Finance and Cryptocurrency: Users and content creators are prohibited from offering financial advice, promoting investment opportunities, or engaging in the sale or exchange of cryptocurrencies or other financial instruments without appropriate licenses and regulatory approvals. This includes, but is not limited to, offering trading tips, promoting specific investments, or facilitating cryptocurrency transactions.
Money Laundering: Any activities that may constitute or facilitate money laundering are strictly forbidden. This includes, but is not limited to, disguising the origins of illegally obtained money, promoting offshore banking services, or engaging in suspicious financial transactions.
Raffles and Gambling: The organization, promotion, or participation in any form of gambling, including raffles, lotteries, or betting activities, is prohibited on the platform. This includes both real-money and simulated gambling activities.
Sale of Eatables or Consumable Goods: The platform prohibits the sale, exchange, or promotion of any eatables, food items, or consumable goods. This includes, but is not limited to, homemade foods, packaged foods, beverages, or any other items intended for human consumption.
Multi-Level Marketing: Any form of multi-level marketing, pyramid schemes, or chain referral systems is strictly prohibited. This includes content that promotes or recruits for such schemes, as well as any attempts to structure the creator-subscriber relationship in a multi-level marketing format.
Weapons and Explosives: The sale, promotion, or instruction in the use of weapons, explosives, or other dangerous items is strictly forbidden. This includes, but is not limited to, firearms, ammunition, explosive materials, and instructions for creating weapons or explosives.
Drugs, Medications, Herbal Mixes, and Supplements: The sale, promotion, or advertisement of any drugs, medications, herbal mixes, or dietary supplements is prohibited. This includes both illegal drugs and prescription medications, as well as any substances claiming to have medical or health benefits.
Preaching and Practice of Witchcraft: Content that promotes, teaches, or glorifies witchcraft, or occult practices, is not permitted on the platform. This includes instructional content, ritualistic practices, or any material that could be considered excessively violent or disturbing.
This provision only pertains to activities that are potentially harmful to another User.
Intellectual Property
Respect for Copyrights and Trademarks: Users and content creators must obtain necessary permissions or licenses before using any copyrighted or trademarked material. This includes but is not limited to, music, images, videos, logos, and brand names
Fair Use Provisions: Content creators may use copyrighted material without permission only if it falls under the fair use doctrine as defined by Indian copyright law. This may include use for criticism, commentary, news reporting, teaching, scholarship, or research. However, users are advised to seek legal counsel if unsure about the applicability of fair use.
Privacy and Data Protection
Compliance with Digital Personal Data Protection Act 2023: The Creators shall adhere to all provisions of the Digital Personal Data Protection Act 2023, including but not limited to:
Obtaining explicit consent from users for data collection and processing
Implementing appropriate security measures to protect personal data
Providing users with the right to access, correct, and delete their personal data
Appointing a Data Protection Officer to oversee compliance.
User Consent for Data Collection and Processing: The platform will obtain clear and informed consent from users before collecting, processing, or sharing any personal data.
Users shall be expected to read the privacy policy available on the Platform to understand the details concerning how their data is collected, used, and protected.
User Behaviour
Respectful Communication: It is humbly urged to keep the interaction between Users that is free from abuse, harassment, or offensive language. Users must communicate in a civil and respectful manner in comments, messages, and all Platform interactions.
No Harassment or Bullying Tolerated: Any behaviour that intimidates, threatens, or causes emotional distress to other Users. Persistent unwanted contact, threats, criminal intimidation, doxxing, or coordinated attacks against other Users are strictly prohibited on the Platform.
Prohibition of Spam and Fraudulent Activities: Any unsolicited and/or bulk messages, deceptive practices, phishing attempts, scams, or false advertising aimed at misleading Users are strictly prohibited.
Content Creator Responsibilities
Accurate Content Descriptions: The Creators are obliged to clear and truthful representation of content to Users before they engage with it. Creators must provide accurate titles, descriptions, and tags for their content mandatorily to avoid confusion and misrepresentation.
Adherence to Platform Policies: Content creators are required to familiarize themselves with and comply with all platform policies, including these guidelines and any subsequent updates.
Transparency in Sponsored Content: Clear and explicit disclosure of any commercial relationships or paid promotions or sponsored Content within the content is expected from the Creator towards the Subscribers and other Users.
Subscriber Interactions
Guidelines for Comments and Feedback: Subscribers must adhere to the following guidelines when interacting with content or other users:
Remain respectful and constructive in all communications;
Refrain from posting spam, offensive content, or irrelevant material; and
Respect the privacy of others and refrain from sharing personal information without consent.
Reporting Mechanisms for Violations: The platform will provide easily accessible mechanisms for users to report content or behaviour that violates these guidelines. Reports will be treated confidentially and investigated promptly.
Moderation, Penalty, and Enforcement
Content Review Process: The Platform utilises a Content review system which may include both automated systems and human moderators, to ensure compliance with these guidelines. The procedures used to evaluate reported content for policy violations. The reported or flagged content will be reviewed by trained moderators within 72 hours of submission of the request.
The Platform is committed to timely review and action as per the requests submitted by the aggrieved Users.
Any content found to be in violation of these guidelines will be immediately removed from the Platform.
Graduated Response to Violations: All reported violations of these guidelines will be thoroughly investigated by the Platform's moderation team. The severity of the violation will be assessed based on the nature of the content, the User's intent, and the potential harm caused.
A system of escalating consequences for repeated policy violations has been implemented.
Violations of these guidelines will be addressed through a graduated response system:
First offence: Warning and temporary content removal.
Second offence: Temporary account suspension for 7 to 14 days (duration based on the severity of violation)
Third offence: Permanent account termination
In cases of severe violations, particularly those involving illegal activities or posing immediate, bodily, or online harm to Users, the Platform reserves the right to immediately terminate the User's account and report the incident to relevant law enforcement agencies.
For Creators found to be in violation of these guidelines, the Platform reserves the right to withhold any earnings generated from the violating content. In cases of repeated or severe violations, the Platform may impose additional financial penalties or demonetize the account as stipulated in the Creator’s agreement.
The Platform reserves the right to pursue legal action against Users or content Creators who engage in illegal activities or cause significant harm to the Platform or its Users.
Appeal Procedures: Users and content Creators will have the right to appeal any moderation decisions. The appeal process will be clearly communicated and conducted fairly and impartially.
Users can submit appeals through a designated Platform interface within 7 days of a moderation action. Appeals found to be frivolous or in bad faith may be disregarded.
Users whose accounts have been terminated may apply for reinstatement after a period of one year. Reinstatement applications will be reviewed on a case-by-case basis and are not guaranteed to be approved.
Data Security
Data Breach Notification Protocols: In the event of a data breach, the Platform will notify affected Users and relevant authorities within the timeframe specified by the Digital Personal Data Protection Act 2023.
Users will be notified within 72 hours of a confirmed data breach affecting their personal information.
Transparency
Regular Transparency Reports: The Platform will publish regular transparency reports detailing content removal requests, account suspensions, and other relevant moderation activities.
Clear Communication of Policy Changes: There shall be timely and accessible notifications of updates to Platform policies and guidelines.
Users will be notified of significant policy changes via email and/or in-Platform notifications at least 7 (seven) days before implementation. The Platform strives for clear communication among all parties.
